Renter requirements
For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest's invitees.
Down payment/ payment
Final payment will be required prior to checking-in to your vacation rental.
Damage policy
As a condition to the rental of all vacation properties, Wischis Florida Home reserves the right to charge the guest's credit card for any and all uncovered guest/invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy. In the event of any uncovered guest/invitee-caused loss or damage to the vacation property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, Wischis Florida Home is hereby granted the right to charge the guest's credit card. By written or electronic endorsement of this agreement, the guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.
The Tenant shall pay for any damage caused to the premises beyond normal wear and tear. For example, normal wear and tear includes minor scuff marks on walls, slight fading of paint, or small carpet stains from everyday use. However, damages such as large holes in walls, broken furniture, or excessive staining that requires professional cleaning are beyond normal wear and tear and will incur additional charges.
Upon arrival
If there are concerns or issues with your rental property, please immediately contact our office per email or phone (leave a message if there is no answer). No refunds or considerations are given unless we are notified of problems during your stay.
Arrival time
Check in is at {reservations.property_check_in_time}. An early arrival may be arranged, pending other reservations and the housekeeping schedule. Please contact us prior to your arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your schedule check in time.
Departure time
Check out is at {reservations.property_check_out_time}. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests.
Cancellations
No refunds will be issued for shortened stays due to weather, family emergencies, or other commitments. For example, if a hurricane disrupts travel plans or a guest must leave early for a personal emergency, the remaining rental period will not be refunded. The cancellation fee is 100% of the rental amount unless another renter is found for the same period. Travel cancellation insurance is recommended. The down payment will NOT be refunded.
Number of Guests
Change in number of guests/conduct of guests: guest(s) agrees that more than the number of people stated on the reservation shall not occupy the premises. Unauthorized people at the vacation rental at any time could result in extra charges for each additional guest, in addition to any and all damage, disturbance, and cleaning charges. The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis - please contact Wischis Florida Home for prior approval. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the cabin can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.
The daily base price is valid for 4 persons. Each additional person is $15 + tax per day. The Tenant shall not sublet the property. The Tenant shall have no more than {reservations.occupants} guests reside or sleep in the house. Every additional person must be declared in writing, including the number of people and the dates of their stay. The total number of guests must NEVER exceed {reservations.unit_max_occupants}.
Utilities and Usage
A $35.00 credit for power use is provided per week. Usage above this will be charged at $0.17 per kWh. For "The Dream," and "The Ranch" gas usage will be charged at $5 per gallon. Air conditioning must not be set below 75 degrees, and heat must not be set above 78 degrees. Doors and windows must remain closed when heat or air conditioning is in use.
Grill and Cleaning
A $25.00 fee will be charged if the grill is not left clean and ready for use.
Linens & towels
Towels, sheets, pillows and blankets are not meant for outside use.
Smoking
Smoking is not permitted in any Wischis Florida Home property. If there is any tobacco smell in the cabin after your departure, you will be charged a cleaning fee. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning.
Pets
No animals or pets are allowed on the premises.
Plumbing
Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain.
Waste Disposal
The Tenant must dispose of all waste in a lawful manner and ensure trash is placed in bins along the curb for pickup. Trash should not be left outside for long periods to avoid attracting animals.
Behavior and Noise
The Tenant and their guests must behave in a civilized manner and respect neighbors rights. Noise and disturbances that could annoy neighbors are prohibited.
Party Prohibition
Parties or large gatherings are strictly prohibited on the property. A "party" or "large gathering" is defined as any event involving more than the agreed-upon number of guests as outlined in the rental agreement, the use of amplified music, or activities that disturb neighbors or exceed reasonable noise levels.
Boat Lift
The boat lift is not part of the rental agreement and may not be used under any circumstances. Damages caused by improper use will result in liability for repairs or replacement costs.
Security
The Tenant is responsible for securing the property by locking doors, windows, and the garage when necessary.
Furnishings and Equipment
Furniture and equipment may change or be removed without replacement. Any equipment provided, such as bicycles or kayaks, is used at the Tenant's own risk. The Tenant and their guests indemnify the Landlord from any claims related to the use of such equipment.
Safety and Hazards
It is the Tenants responsibility to familiarize themselves with pool safety, including supervising minors. The Tenant acknowledges that the pool and dock areas pose risks. The property contains gas-powered items. Tenants should seek help if unsure of their operation. The property has fire alarms installed and they are believed to function properly at the time of rental. The Tenant will notify management without delay if a fire alarm chirps or has a low battery condition. The Tenant is advised that there is no carbon monoxide detector on the property and accepts the risk involved in not having one.
Internet
High-speed internet is provided as a convenience only, and no refunds will be given for outages or service issues.
Insurance and Liability
The Tenant indemnifies the Landlord against any claims of injury or property damage. The Landlords insurance does not cover the Tenants personal property; renters' insurance is recommended.
Rebooking Fee
If the Tenant requests to rebook the rental for a different date, a rebooking fee of $250 will apply. This fee is in addition to any difference in rental costs between the original and the new dates. We accept rebookings until 90 days prior to arrival.
Outages and Maintenance
No refunds or compensation will be given for service outages (e.g., cable, internet) beyond the Landlords control.
Property Sales and Termination
If the property is sold and the new owner does not honor the rental contract, the agreement may be terminated, and the rental fees will be refunded. In the event that the marketing and property management through Wischis Florida LLC ends before the beginning of the rental period, Wischis Florida LLC is entitled to terminate the existing rental contract. In case of termination, the rental fees will be refunded within 14 days of the termination. Further claims by the Tenant, especially compensation claims, are hereby excluded.
Chargebacks and Dispute Resolution
Waiver of Chargeback Rights: The Tenant agrees not to initiate chargebacks for any payments made under this agreement. This clause is in place to protect the integrity of the rental process and to avoid unnecessary disputes or interruptions. Should the Tenant have any concerns or grievances regarding payments or services, they are encouraged to address these issues directly with Wischis Florida LLC to seek an amicable resolution. Chargebacks can cause delays and administrative complications that are not in the best interest of either party.
Mandatory Mediation: All disputes must first be resolved through mediation within Lee County, Florida, at the Tenants expense.
Exclusion of Legal Action Before Mediation: Legal proceedings are prohibited before completing the mediation process.
Enforceability: Any unresolved disputes must be filed in a Lee County, Florida court. This agreement is governed by Florida law.
Force Majeure
In the event that the rental of the selected property is significantly complicated, affected, or threatened by force majeure, the Landlord reserves the right to terminate the rental contract. This provision also applies to the Tenant.
Use of Property
The Tenant agrees to use the property for lawful purposes only. Any illegal activity, including but not limited to the use of illegal drugs, abuse of any individual, harboring fugitives, or similar actions, shall result in the immediate termination of this agreement, with no refund of rent or deposit.
Owners Closet
The Tenant agrees not to access the Owner's closet.
Television Programming
Television programming is provided according to the service level chosen by the Landlord. No rent refunds will be given for outages, content issues, lack of content, or personal preferences regarding TV services.
No Side Agreements
There are no side agreements. Any changes or additions to the existing regulations shall only be valid if agreed upon in writing. This also applies to the revocation of this clause.
Final Provisions
Any changes to this agreement must be made in writing. Oral agreements are not valid. If any clause is deemed invalid, the remaining provisions shall remain effective, and a replacement clause shall be agreed upon to reflect the original intent.
Security Deposit
The security deposit will be refunded 14 business days after the tenant's departure. For our Non US-Guests we will using the exchange rate from the day of the final payment (check in date).
Right of entry
Guest(s) agree that Wischis Florida Home reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate.
Security & safety risks
Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the vacation rental. Wischis Florida Home does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard except citronella candles in buckets outside, or supplied emergency candles in case of power outage.
Indemnification & hold harmless
While Wischis Florida Home and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Wischis Florida Home and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Wischis Florida Home and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify Wischis Florida Home and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property. |
